Terms of Service

1. Agreement to Terms

By creating an account, accessing, or using the fundr platform ("Service"), you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. By checking the "I agree" box during registration, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.

2. Service Description

fundr provides automated trading software ("Bot") that you configure and deploy on your own third-party prop firm evaluation and funded accounts through your own PickMyTrade webhook connection. The Service includes guided setup assistance, a dashboard, and ongoing software updates. You keep full control over activation, deactivation, and configuration at all times.

The Service is a software tool only. fundr is not a broker, investment adviser, commodity trading advisor, fund manager, or financial institution. We do not hold, manage, or have access to your trading capital, and we never log into your prop firm account.

3. No Guarantee of Performance

PAST PERFORMANCE IS NOT INDICATIVE OF FUTURE RESULTS. Trading futures involves substantial risk of loss and is not suitable for all individuals. You acknowledge that:

• No trading system can guarantee profits or prevent losses.
• The Bot will have drawdowns, losing streaks, days without trades, and periods of underperformance.
• Stop orders are not guarantees; fast markets and gaps can fill worse than the stop price, and a failed order send can leave a position open.
• You may lose some or all of the money in your trading accounts, including evaluation and reset fees.
• Any performance data, backtests, or trade history shown is for information only and is not a promise of future results.

4. Plans and Fees

The Service is offered on these plans, in USD, all with the same access: Monthly $250 per month (billed in advance, renewing monthly until cancelled); Annual $2,500 per year (billed in advance, renewing yearly until cancelled); Lifetime $5,000 as a single payment. Promotional codes apply only as stated at checkout.

We may change prices at any time; a change never affects a period you have already paid for, and existing subscribers get reasonable notice before a renewal at a new price. Prop firm evaluation, reset, activation and data fees, and any broker or PickMyTrade charges, are your responsibility and are paid to those providers.

5. Payment Processing

Payments are processed by Whop, our payment provider, and are subject to Whop's terms. Checkout takes place on Whop's hosted pages. fundr never receives or stores your full card details. You can view receipts, update your payment method, and cancel a recurring plan from your Whop account at any time.

6. Lifetime Access

"Lifetime" means the operational lifetime of the Service, not your lifetime. Lifetime access is personal to you and may not be sold, transferred or shared. It includes updates generally released to all customers. If we permanently discontinue the Service we will give Lifetime customers at least thirty (30) days' notice by email; discontinuation does not entitle you to a refund except where required by law.

7. Refunds

All sales are final and all fees are non-refundable, except where a refund is required by applicable law. Fees are not refundable because of dissatisfaction with results, trading losses, prop firm violations or disqualifications, or change of mind. Cancelling a recurring plan stops future charges; it does not refund charges already made. Nothing here limits a statutory consumer right that cannot be waived.

8. Chargebacks and Disputes

Please contact support@fundralgo.com before filing a payment dispute. If a chargeback is filed we may suspend access while it is resolved.

9. Disclaimer of Liability

To the fullest extent permitted by law, fundr is not liable for trading losses, missed trades, slippage, execution failures, prop firm account violations or disqualifications, data feed errors, webhook delivery failures, outages, or any indirect, incidental, special, consequential or punitive damages, or lost profits. Our total liability is limited to the amount you paid fundr in the twelve (12) months before the event giving rise to the claim.

10. Self-Directed Use and Assumption of Risk

You are a self-directed user of this software. fundr does not manage your accounts, make individualized trading decisions for you, or act as your agent. You choose to configure and activate the software on your own accounts and are solely responsible for all activity on them, including orders placed by the Bot you activated. You can pause, reconfigure or disconnect the Bot at any time. You confirm you understand and accept the rules of every prop firm whose accounts you connect, including any rules on automation.

11. Cancellation and Termination

You may cancel a recurring plan at any time from Billing or your Whop account. Cancellation takes effect at the end of the current period: you will not be charged again, and the Bot keeps running until the end of the period you paid for. After that, orders stop and dashboard access ends. We may suspend or terminate accounts for breach of these Terms, non-payment, abuse, or where required by law.

12. Intellectual Property and Confidentiality

All strategies, algorithms, signal logic, software, and systems are the exclusive property of fundr. You agree not to reverse-engineer, copy, scrape, redistribute, resell, or share any part of the Service, including trading logic, signal methodology, dashboard code, or API endpoints, and not to share your account access.

13. Indemnification

You agree to indemnify and hold harmless fundr and its owners, employees and agents from claims, damages, losses and expenses (including attorney's fees) arising from your use of the Service, your breach of these Terms, or your violation of third-party rights or prop firm rules.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes are resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Florida. You waive participation in class actions or class-wide arbitration. Either party may use small-claims court where eligible.

15. Text Messages

If you give us your mobile number, fundr sends account and setup texts to it, and marketing texts only if you separately opt in. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help.

16. Changes, Severability, Entire Agreement

We may update these Terms; changes take effect when posted, except that fee or cancellation changes apply from your next renewal. If a provision is unenforceable it is limited to the minimum extent necessary. These Terms, the Privacy Policy and your order confirmations are the entire agreement.
